This Acceptable Use Policy ("AUP") is an integral part of your agreement with ENGINYRING Europe SRL ("ENGINYRING") and is incorporated by reference into our Terms of Service. This AUP governs the use of all services provided by ENGINYRING (the "Services"). The User bears sole and exclusive responsibility for all activities conducted through the Services. Violation of this AUP constitutes a material breach of the Terms of Service and may result in immediate suspension or termination of your Services without refund.


1. Purpose

The objectives of this AUP are to:

  • Ensure the security, stability, and reliability of our network and services for all users.
  • Promote the responsible use of internet resources and discourage activities that degrade the usability and value of the internet.
  • Protect the rights, privacy, and security of individuals and organizations.
  • Comply with all applicable laws and regulations.

2. General Rules of Conduct

2.1 The User bears sole responsibility for ensuring their use of the Services is lawful and does not interfere with or disrupt other users, networks, or services on the internet.

2.2 The User must comply with all reasonably formulated instructions from ENGINYRING regarding the use of the Services.

2.3 The User is strictly prohibited from transmitting, hosting, or posting any material that is illegal, unlawful, threatening, abusive, discriminatory, defamatory, or encourages conduct that could be considered a criminal offense, give rise to civil liability, or otherwise violate any Romanian or international laws.

2.4 The User is strictly liable for preventing the distribution of computer viruses, malware, or other malicious programs through their use of the Services.

2.5 The User must ensure that any systems connected to our network are configured with adequate security measures. The adequacy of such measures shall be determined by ENGINYRING in its sole discretion.

2.6 The User is responsible for maintaining the confidentiality of all account credentials (including passwords) and must inform ENGINYRING immediately of any suspected or actual unauthorized access to their account or services.

3. Prohibited Activities

The following activities are strictly prohibited. Engaging in any of these activities, directly or indirectly, will be considered a material breach of this AUP:

  • Unauthorized Access: Accessing or attempting to access any system, account, or data without authorization (e.g., hacking, port scanning).
  • Denial of Service (DoS): Launching or participating in any DoS or Distributed Denial of Service (DDoS) attacks against any target.
  • Interference: Intercepting, monitoring, or manipulating network traffic not intended for the User.
  • Spam & Unsolicited Communication: Sending unsolicited bulk email (spam), mail bombing, or any other form of abusive electronic communication.
  • Forgery & Impersonation: Falsifying or manipulating electronic message headers, IP addresses, or any other identifier to impersonate another person or entity.
  • Malware Distribution: Hosting, distributing, or linking to any form of malware, viruses, trojans, phishing sites, or other malicious code.
  • Illegal & Harmful Content: Hosting, distributing, or transmitting content related to:
    • Child sexual abuse material (CSAM) or any form of child exploitation.
    • Content that promotes terrorism, incites hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, or any other protected characteristic.
    • Content that facilitates illegal activities (e.g., illegal drug trade, illegal gambling).
    • Unauthorized distribution of copyrighted or trademarked material (piracy).
    • Content that infringes on the privacy, personal data, or other rights of individuals.
  • Resource Abuse: Using the Services in a manner that consumes excessive resources (CPU, memory, I/O, network) to the detriment of other users. This includes, but is not limited to, cryptocurrency mining.
  • Circumvention of Security: Attempting to bypass or disable any security, filtering, or authentication measures of our Services or network.
  • Catch-All Provision: Engaging in any other activity that ENGINYRING, in its sole and absolute discretion, determines to be harmful, abusive, or threatening to its network, services, reputation, or other users.

4. Specific Service Restrictions

4.1 Email and SMTP: By default, SMTP(s) traffic (ports 25, 465, 587) is blocked on all server plans. This restriction may be lifted only upon successful completion of our comprehensive KYC validation and agreement to an additional monthly fee. If the user engages in any bulk mailing activities (whether solicited or not) after the restriction is lifted, the SMTP(s) block will be permanently reinstated without refund.

4.2 Network Usage: Our services may not be used for operating open proxies, TOR relays/exits, or any service intended to anonymize or obscure network traffic without our explicit prior written consent.

4.3 File Hosting: The Services may not be used for the primary purpose of mass file hosting, archival, or as a public-facing Content Delivery Network (CDN) without a specific agreement to that effect.

4.4 ENGINYRING reserves the sole and absolute discretion to determine what constitutes excessive or abusive resource consumption.

5. Monitoring and Enforcement

5.1 ENGINYRING has no obligation to monitor user activity, but reserves the right to investigate any reported or suspected violation.

5.2 ENGINYRING is the sole arbiter of what constitutes a violation of this AUP. Our determination is final and binding, and we are not required to provide an opportunity to cure before taking action.

5.3 In response to a violation, we may take any action we deem appropriate, including but not limited to:

  • Issuing a formal warning.
  • Suspending access to the Services.
  • Terminating the Services immediately and without prior notice.
  • Removing or blocking access to the offending content.
  • Charging the user for costs incurred in investigating and remediating the violation.
  • Reporting the illegal activity to the appropriate law enforcement authorities.

6. Security Requirements

6.1 The User is strictly and solely liable for maintaining the security of their systems, accounts, and content. This includes:

  • Using strong, unique passwords and enabling two-factor authentication where available.
  • Keeping all software, applications, and scripts updated with the latest security patches.
  • Implementing appropriate firewalls and access controls.
  • Regularly backing up all critical data.

6.2 If we detect a security vulnerability on a user's service, we reserve the right to take immediate protective action, including temporary suspension, to protect our network and other users.

7. Reporting Abuse

7.1 To report a violation of this AUP or any illegal content hosted on our network, please contact our abuse team immediately via:

7.2 Please provide detailed information to facilitate our investigation, including the nature of the abuse, timestamps, and the IP address or domain involved.

8. Modifications to this Policy

8.1 ENGINYRING reserves the right to revise this AUP at any time. We will provide notice of material changes via email or a notice on our website. Continued use of our services after such notification constitutes acceptance of the updated policy.

9. Consequences of Violation

9.1 A violation of this AUP is considered a material breach of our Terms of Service and may result in the immediate suspension or termination of your services without refund or credit.

9.2 You shall be held liable for and agree to fully indemnify ENGINYRING for any and all costs, damages, fines, or legal fees incurred by ENGINYRING as a direct or indirect result of your violation of this AUP.
