Acceptable Use Policy

This Acceptable Use Policy ("AUP") defines the acceptable use of services provided by ENGINYRING Europe SRL (hereinafter "ENGINYRING") and outlines the responsibilities of clients and users of ENGINYRING's services (hereinafter "user[s]"). When provisions of this Acceptable Use Policy are violated, ENGINYRING can take measures, as defined in our Terms of Service, to address the continuation or repetition of the violation.


1. Purpose

The objectives of the Acceptable Use Policy include:

  • Offering users safe and reliable internet services.
  • Contributing to the open nature of the internet and the value of the internet as a platform for freedom of speech.
  • Promoting the responsible use of the internet and counteracting practices that negatively affect the value of the internet.
  • Protection of the rights, privacy, and (internet) security of individuals and organizations.
  • Indicating the rights and obligations ENGINYRING provides users with, in addition to statutory rights and obligations.

2. General Rules of Conduct

2.1 The starting point is that users behave as proper and careful internet users and do not cause any inconvenience to other users and/or networks on the internet.

2.2 The user shall follow reasonably formulated instructions from ENGINYRING regarding the offered internet services.

2.3 The user shall refrain from transmitting or posting any material, of any form, on the internet, which can be regarded as illegal, unlawful, threatening, discriminatory, libelous, encouraging or triggering conducts that can be considered criminal, which could give civil liability to, or could otherwise result in a conflict with Romanian law or international laws and regulations.

2.4 The user will do everything reasonably possible to prevent computer viruses or other malicious programs from being posted on or transmitted through the internet or ENGINYRING's infrastructure.

2.5 The user will do everything reasonably possible to only connect systems with adequate security to the internet.

2.6 ENGINYRING is extremely careful with users' confidential information (including passwords) and expects the same degree of care from its users.

2.7 The users will inform ENGINYRING as soon as possible if any confidential data from or provided by ENGINYRING has come into the hands of unauthorized parties, or in case of suspicion thereof.

2.8 The user will inform ENGINYRING as soon as possible when unauthorized parties have had access to the services, or in case of suspicion thereof.

3. Prohibited Activities

The user shall refrain from any attempt, in any way whatsoever, to:

  • Invade third party systems or using third party accounts without authorization.
  • Gain access to data not intended for the user.
  • Carry out any denial of service attacks.
  • Intercept or manipulate third party network traffic without consent.
  • Send spam or engage in bulk mailing activities without proper authorization.
  • Manipulate electronic messages (including email headers).
  • Distribute malware, viruses, or other malicious code.
  • Host, distribute, or transmit content related to:
    • Child exploitation or abuse material
    • Content that promotes discrimination, hatred, or violence
    • Content that facilitates illegal activities
    • Unauthorized distribution of copyrighted material
    • Content that infringes on the privacy or personal rights of individuals
  • Use our services for any purpose that violates applicable laws or regulations.
  • Attempt to circumvent or disable any security features of our services.
  • Use our services in a way that consumes excessive resources or disrupts normal operations for other users.

4. Specific Service Restrictions

4.1 Email and SMTP Restrictions: By default, SMTP(s) traffic is blocked on all virtual and dedicated server plans. This restriction may be lifted only upon successful completion of comprehensive KYC validation or upon agreement to a fee of €20 per month. If the user engages in any bulk mailing activities after the restriction is lifted, the SMTP(s) block will be permanently reinstated.

4.2 Resource Usage: Users must ensure their applications do not consume excessive CPU, memory, disk space, or network capacity that could negatively impact the performance of our services for other users. ENGINYRING reserves the right to throttle or suspend services that consume excessive resources.

4.3 Content Delivery: Our services may not be used primarily as a Content Delivery Network (CDN) or for file hosting services without explicit written permission.

5. Monitoring and Enforcement

5.1 While ENGINYRING does not actively monitor user content, we reserve the right to investigate suspected violations of this AUP.

5.2 ENGINYRING may take remedial action against any user who violates this AUP. Such actions may include, but are not limited to:

  • Issuing warnings
  • Suspending or terminating services
  • Removing or blocking access to content
  • Imposing additional fees for remediation
  • Reporting illegal activities to appropriate authorities

5.3 If you become aware of any violation of this AUP, please report it immediately to abuse@enginyring.com.

6. Security Requirements

6.1 Users are responsible for maintaining the security of their systems and content, including:

  • Using strong, unique passwords for all accounts
  • Keeping all software and applications updated with the latest security patches
  • Implementing appropriate access controls to prevent unauthorized access
  • Configuring services securely, including disabling unnecessary services
  • Implementing proper backup procedures for all important data

6.2 If ENGINYRING detects security vulnerabilities in a user's systems, we may take immediate action to protect our network and other users, including temporary suspension of services until the vulnerability is remediated.

7. Reporting Abuse

7.1 If you believe any user of ENGINYRING's services is violating this AUP or you wish to report illegal or harmful content, please contact us immediately by:

7.2 Please provide as much relevant information as possible, including:

  • The nature of the violation
  • When it occurred
  • The IP address or domain involved (if applicable)
  • Any supporting evidence

7.3 ENGINYRING will investigate all credible reports and take appropriate action in accordance with this AUP and our Terms of Service.

8. Modifications to this Policy

8.1 ENGINYRING reserves the right to revise this Acceptable Use Policy from time to time in accordance with social and technological developments.

8.2 We will notify users of material changes to this policy by email or through a notice on our website.

8.3 Continued use of our services after such notification constitutes acceptance of the updated policy.

9. Consequences of Violation

9.1 Violation of this AUP may result in immediate suspension or termination of your services without prior notice.

9.2 ENGINYRING reserves the right to charge the user for any costs incurred as a result of policy violations, including but not limited to administrative costs, technical resources, and legal fees.

9.3 Depending on the severity of the violation, ENGINYRING may report illegal activities to appropriate law enforcement authorities.
